Wired reports that Homeland Security agents recently contacted a member of Occupy Boston to discuss one of the stranger incidents from OB's tenure in Dewey Square.

As first reported by the Phoenix's Chris Faraone, in the bleary early-morning hours of December 10 -- just an hour or so before Boston Police raided the Dewey Square tent city, ending the longest-running #OWS encampment in the country -- an unidentified man either smacked or punched Robin Jacks in the face, grabbed her iPhone, and took off.

Standing in front of the floor-to-ceiling glass storefront at Jamaica Plain’s Lucy Parsons Center, a radical bookstore and community space, the anarchist author and activist speaks of her experiences in with Occupy Philly, anarchism, and the intersections of the two.

Chris Faraone (@Fara1) and Ariel Shearer (@arielshearer) were on the scene early Saturday morning as Boston Police -- many with black tape covering badge numbers -- arrested around 40 protesters and cleared Dewey Square. According to reports, two legal observers were among those arrested. Faraone, who has ripped the BPD a new asshole on numerous occasions and has been covering Occupy around the clock since the beginning -- here in Boston and around the country -- was singled out by the police and removed from a designated press viewing area.

Liz Pelly reports that some campers are breaking down their tents -- but also points out that this is being done autonomously.

The ACLU and the National Lawyers Guild, who filed the injunction on behaf of Occupy Boston that prevented the City of Boston from removing the group from Dewey Square -- an injunction that was voided today -- say they are "reviewing the decision with our clients to determine all their options." Just received from Mayor Thomas Menino's office:

“We are pleased with Judge McIntyre’s strong decision to repeal the restraining order that prohibited the City of Boston from removing the Occupy Boston camp at Dewey Square. We applaud the judge for clearly recognizing the City’s authority to protect all of our residents, including those currently at Dewey Square.

"Little in the way of expression is outlawed under the United States Constitution, but an act which incites a lawful forceful response is unlikely to pass as expressive speech."

Not having been able yet to talk with the attorneys involved, I'm not going to try to dissect the ruling too much. But I do find one thing very interesting: Judge McIntyre posits that a new, unprecedented legal question has been raised. From page 11-12 of the ruling (read the full ruling here):

They claim that their message of economic equality and more perfect democracy can only be effectively communicated through the "literal occupation of Boston in the financial district."

Suffolk Superior Court Judge Frances McIntyre ruled against Occupy Boston this afternoon, declining to issue an injunction and lifting the temporary restraining order that has barred the City of Boston from evicting the campers from Dewey Square. You can read the full decision here.

The ruling came earlier than many expected.

The city of Boston currently has no set plans to evict the camp, but Occupy Boston is urging supporters to convene at Dewey Square tonight in preparation for potential eviction.
